1.     GENERAL

At Live a Moment, we know you care about your personal information, so we have prepared this privacy policy (our “Privacy Policy”) to explain how we collect, use and share it. By using or accessing the Service, you agree to the terms of this Privacy Policy. We may update our Privacy Policy to reflect changes to our information practices. If we do this and the changes are material, we will post a notice that we have made changes to this Privacy Policy on the Website for at least 7 days after the changes are made, and we will indicate the date these terms were last revised at the top of the Privacy Policy. Any revisions to this Privacy Policy will become effective the earlier of (i) the end of that 7-day period or (ii) the first time you access or use the Service after any such changes. By using the Live a Moment mobile application (the “Application”), content, and all other products and services (all of the foregoing collectively, the “Services”), you hereby warrant and represent that you have read, understand and agree to this Privacy Policy and that you are over 13 years of age.  PLEASE DO NOT USE, INSTALL OR ACCESS THE SERVICES IF YOU DO NOT AGREE TO THIS PRIVACY POLICY.

2.     IMPORTANT – TRANSFER OF DATA AND PERSONAL INFORMATION TO THE U.S.

WE PRIMARILY STORE DATA ABOUT YOU, INCLUDING PERSONAL INFORMATION, ON SERVERS LOCATED AND OPERATED WITHIN THE UNITED STATES. IF YOU RESIDE OUTSIDE OF THE UNITED STATES, IN ORDER TO PROVIDE THE SERVICES TO YOU, WE MAY SEND AND STORE YOUR PERSONAL INFORMATION (ALSO COMMONLY REFERRED TO AS PERSONAL DATA) OUTSIDE OF THE COUNTRY WHERE YOU RESIDE OR ARE LOCATED, TO THE UNITED STATES. THEREFORE, OUR COLLECTION AND USE OF YOUR PERSONAL INFORMATION IS SUBJECT TO THE UNITED STATES’ LAWS RELATED TO PRIVACY AND USE OF PERSONAL DATA AND INFORMATION.  THESE LAWS, INCLUDING WHAT IS DETERMINED TO BE “PERSONAL DATA AND/OR INFORMATION,” ARE DIFFERENT AND MAY BE LESS PROTECTIVE THAN THOSE APPLICABLE TO YOU IN YOUR COUNTRY OF RESIDENCE. BY ACCEPTING THE TERMS OF THIS PRIVACY POLICY, YOU ACKNOWLEDGE, AGREE AND CONSENT TO (1) THE TRANSFER TO AND PROCESSING OF PERSONAL INFORMATION ON SERVERS LOCATED OUTSIDE OF THE COUNTRY WHERE YOU RESIDE, (2) OUR COLLECTION AND USE OF YOUR PERSONAL INFORMATION AS DESCRIBED HEREIN AND IN ACCORDANCE WITH THE LAWS OF THE UNITED STATES THAT MAY BE DIFFERENT AND MAY BE LESS PROTECTIVE THAN THOSE IN YOUR COUNTRY AND (3) THAT YOU ARE TAKING A RISK BY USING THE SITES AND SERVICES.

3.     INFORMATION WE COLLECT

When you use the Services, you provide us with two types of information: (i) information you submit via the Application and (ii) information regarding your use of the Services collected by us as you interact with the Services.

Through the registration process for the Services, we may collect your email address, location data, Facebook ID, Facebook profile image url, and other information that may be requested during the registration process. Once you become a registered user of the Services, we may also collect transaction-related data for purchases you make while using the Services.

We may use, depending on the Services, (i) location based on the IP address presented by you, (ii) network-based geo-location data based on proximity of network towers or the location of Wi-Fi networks, and/or (iii) geo-location data based on coordinates obtained from a mobile device’s GPS radio and location services.  Your GPS geo-location is not accessed without your consent.  If location services are enabled on your mobile device, certain of the Services will passively and automatically send location information to Signal Zero in order to for us to deliver location-specific information on your device and compile your individualized timeline. Please note that disabling location service will not anonymize data already collected and uploaded to our servers. 

When you use the Application you may submit information and content to your profile, and generate activity data through engaging in activities on the Application (“Activity Data”). We store this information so that we can provide you the Services and offer personalized features.

We use third-party analytics tools to help us measure traffic and usage trends for the Services. We may collect and use this analytics information together with your personal information and stitch together session data from unauthenticated user visits with authenticated user visits to build a broader profile of our individual users so that we can serve you better.

Other than as described herein, we do not share your personal information with third-parties other than in aggregated, anonymized form, unless it is necessary to offer the Services or required by law (see below for specifics).

4.     USE OF INFORMATION OBTAINED BY LIVE A MOMENT

We may use your contact information to send you notifications regarding new services offered by Live a Moment that we think you may find valuable. Live a Moment may also send you service-related announcements from time to time through the general operation of the Services. Generally, you may opt out of such emails.

Profile information is used by Live a Moment to be presented back to and edited by you when you access the Services and to be presented to other users. In some cases, other users may be able to supplement your profile, including by submitting comments (which can be deleted by you).

Live a Moment may use or share aggregate or anonymous data collected through the Services, including Activity Data, for purposes such as understanding or improving the service.

5.     SHARING YOUR PERSONALLY-IDENTIFIABLE INFORMATION WITH THIRD PARTIES

Live a Moment shares your personally-identifiable information only when it is reasonably necessary to offer the Services, legally required, or permitted by you. For example:

We may provide personally-identifiable information to service providers who help us bring you the Services, such as hosting the Services at a co-location facility or sending email updates. In connection with these operations, our service providers may have access to personally-identifiable information for a limited time. When we utilize service providers for processing any personally-identifiable information, we implement reasonable contractual protections limiting the use of that personally-identifiable information to the provision of services to Live a Moment.

We may be required to disclose personally-identifiable information in response to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. Additionally, we may share account or other personally-identifiable information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the Service or using the Live a Moment name, or to prevent imminent harm. This may include sharing personally-identifiable information with other companies, lawyers, agents or government agencies.

If the ownership of all or substantially all of the Live a Moment business, or individual business units or assets owned by Live a Moment that are related to the Service, were to change, your personally-identifiable information may be transferred to the new owner. In any such transfer of information, your personally-identifiable information would remain subject to this section.

6.     UPDATING OR DELETING YOUR PERSONALLY-IDENTIFIABLE INFORMATION

You have at all times the right to delete your account with Live a Moment by following the instructions available through the Application. After your account is deleted we will retain aggregate or anonymous data collected through the Application, including Activity Data, which may be used by Live a Moment and shared with third parties in any manner.

7.     CHILDREN

We do not knowingly collect personal information from children under 13 years of age.  Our Services is not directed to children under the age of 13 and children under 13 are not permitted to use the Services.  If we become aware that we have unknowingly collected personal information from a child under the age of 13, we will make commercially reasonable efforts to delete such information from our database.  If you are a parent or guardian of a child under the age of 13, and you believe that your child has provided us with personal information, please contact us at info@liveamoment.com.

8.     CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83 entitles residents of the State of California to request from a business, with whom that resident has an established business relationship, certain information regarding the types of personal information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year. 9.     LINKS

The Service may contain links to other websites. We are not responsible for the privacy practices of other websites. We encourage users to be aware when they leave the Service to read the privacy statements of other websites that collect personally identifiable information. This Privacy Policy applies only to information collected by Live a Moment via the Service.

10.  INFORMATION SECURITY

Live a Moment has implemented administrative and technical safeguards it believes are sufficient to protect the confidentiality, integrity and availability of your User Photo, access credentials, and Activity Data. However, we believe that a determined attacker with sufficient resources could defeat those safeguards and may, as a result, gain access to the information we seek to protect.

11.  DO NOT TRACK

The Service is not designed to respond to “do not track” signals sent by some browsers.

12.  JURISDICTION

All information passed through the Services is primarily handled in the United States but may from time to time be handled in any country in which Live a Moment or its affiliate companies maintain facilities. By using the Services, you agree that the handling of your personal information and any communication through the Services will be governed by the laws of the United States and any applicable state laws.
